Terms of Service: Accounts, Credits, Refunds and Acceptable Use

These Terms of Service govern your use of trykissai (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Content Policy. If you do not agree, do not use the Service.

trykissai is operated by an independent developer as an individual, not by a registered company. In these Terms, "we", "us" and "our" mean that operator. You can reach us at support@trykissai.com.

You can sign up with an email address and password or with a Google account. Provide accurate information, keep your login details secure, and tell us promptly if you think someone has used your account without permission. You are responsible for activity under your account. Creating multiple accounts to collect extra free credits is not allowed.

You must be at least 18 years old to use this service. Content involving minors is strictly prohibited. We do not knowingly collect personal information from children under 13 (COPPA).

Only upload photos you have the right to use, and only of adults who have agreed to appear in a kiss photo or video. You may not use the Service for anything unlawful, deceptive or harmful, including the uses banned by our Content Policy. You may not try to get around safety checks, credit limits or rate limits, or access the Service by automated means we have not allowed.

Photos and videos are paid for with credits. The credit cost of each job is shown before you start it, and the credits are reserved when the job starts. If a job fails, or you cancel it before it finishes, the reserved credits return to your account automatically.

New accounts receive free trial credits that expire 30 days after they are granted. Credit packs are one-time purchases, not subscriptions, and are paid through Stripe. Credits from a pack expire 90 days after purchase.

Credits have no cash value and cannot be transferred, sold or exchanged. Expired credits are not restored. Prices are shown in US dollars; your bank may add currency conversion or other fees.

Credits are added to your account as soon as payment succeeds, so credit pack purchases are final and non-refundable, except in these cases:

• you were charged more than once for the same purchase;
• the payment was made without your authorization;
• a fault on our side stopped the purchased credits from reaching your account, and we cannot fix it.

Credits returned after a failed or cancelled job go back to your credit balance; they are not a cash refund.

To request a refund, email support@trykissai.com within 30 days of the charge, from the email address on your account, with the date and amount of the payment. Approved refunds are paid back to the original payment method through Stripe, and the related credits are removed from your account.

Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded by contract.

You keep whatever rights you have in the photos you upload and in the results you generate. You allow us to store, process and transmit them only as needed to run your jobs, deliver results and keep the Service safe. You are responsible for how you use and share your results, and you must not present them as real events in a way that could deceive or harm anyone. The Service itself, including the site, software, design and preset kiss scenes, belongs to us.

We may change, suspend or discontinue features at any time, and we do not guarantee that the Service will always be available or free of errors. Generated results are deleted 7 days after they are created, so download anything you want to keep.

We may suspend or close accounts that break these Terms or the Content Policy, without notice when the violation is serious. Credits left on an account closed for a violation are forfeited and not refunded. You can stop using the Service at any time and ask us to delete your account by emailing support@trykissai.com.

The Service is provided "as is" and "as available", without warranties of any kind. AI results can be inaccurate or unexpected. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. These limits do not apply where the law does not allow them.

We may update these Terms from time to time. The effective date at the top of this page shows when they last changed. If a change materially affects your rights, we will tell you by email or by a notice on the site before it takes effect. If you keep using the Service after that, you accept the updated Terms.
